Business Legal Name: Nu-Tech Boatworks, LLC (“Nu-Tech,” “we,” “our,” “us”)
Contact: 667-266-0005
By requesting an estimate, booking service, paying an invoice, signing a work order, or leaving a vessel/equipment in our care, you (“Customer,” “you,” “your”) agree to these Terms & Conditions.
1) Scope of Services
We provide marine surface restoration and related services, including: gelcoat repair, fiberglass/composite repair, color-sand & polish/oxidation removal, detailing, 3M® pontoon tube vinyl wraps, minor hardware R&R related to surface work, and other services listed on your estimate or invoice.
2) Estimates, Pricing & Approvals
-
Estimates are based on visible conditions and information provided and are not a guarantee. Hidden damage, prior repairs, moisture, or corrosion may require change orders.
-
Hourly/Time & Materials items are billed at our then-current shop rate. Materials may include shop supplies, abrasives, resins, adhesives, films, cleaners, masking, disposal, etc.
-
Approvals: We begin after written/email/text approval or deposit. Digital signatures and “Reply YES” approvals are binding.
3) Payments & Late Fees
-
Balance: Due upon completion and before release of vessel unless otherwise stated in writing.
-
Commercial/Dealer Accounts: Net [15/30] days with approved credit and PO.
-
Late fees: 2% per month on past-due balances; $20/day storage after 5 days of completion notice if pickup or payment is delayed.
-
We accept Card, Zelle, Check, Wire, and Cash. We may exercise all rights under Maryland law to collect unpaid balances, including filing liens where applicable.
4) Scheduling, Access & Weather
-
Dates are targets and may shift due to weather, humidity/temperature windows, drying/curing times, material availability, or preceding jobs.
-
You must provide safe access, keys/codes, and slip/yard authorization. For mobile work, provide shore power/water if needed.
-
We may reschedule if conditions are unsafe or outside manufacturer installation specs.
5) Customer Responsibilities (Prep & Disclosure)
-
Remove or secure personal items. We are not responsible for unsecured gear, electronics, or valuables left aboard.
-
Disclose prior repairs, repaints, silicone contamination, fuel/oil leaks, osmosis/blistering, or structural issues.
-
Confirm haul-out/launch times with your marina/yard and ensure all yard fees are paid.
6) Change Orders & Extra Work
Any work outside the written estimate (e.g., hidden delamination, color-match blending into adjacent panels, hardware re-rigging) will be quoted or billed as a change order. We will obtain text/email approval whenever practicable.
7) Cancellations & Rescheduling
-
Cancel/reschedule at least 48 hours prior to the appointment. Short-notice cancellations may forfeit the deposit or incur a $(Materials) fee if materials were custom-ordered or time blocked.
-
If we arrive and cannot proceed due to access/prep issues, a trip/standby fee may apply.
8) Workmanship Warranty
We stand behind our workmanship under normal recreational use:
a) Gelcoat/Fiberglass Repairs – 12 months against workmanship defects (e.g., pinholes not sealed, fairing print-through due to process), starting the date of completion.
b) Detailing/Polish/Coatings – As-stated on your invoice (detailing is consumable and affected by care, storage, and sun/salt exposure).
c) Pontoon Vinyl Wraps (3M film) – Workmanship: 12 months against installation defects such as lifting at seams caused by installer error. Film/adhesive carries the manufacturer’s limited warranty (terms vary by product, color, exposure, and waterline location). We will help you submit a 3M claim if applicable.
Warranty Claim Process: Notify us in writing with photos within 7 days of discovery; allow inspection and one reasonable attempt to repair. Warranty is limited to repair or re-performance of the specific work; no cash refunds.
Exclusions (all services): impacts/abrasion/dock rash/grounding, pressure-washer or abrasive damage, chemical spills/incorrect cleaners, neglect, UV/salt buildup, normal wear, electrolysis/galvanic corrosion, hull blistering/osmosis, movement of substrates, pre-existing or hidden defects, moisture intrusion, silicone contamination, aftermarket cleaners/waxes/ceramics not recommended by us or the manufacturer, use outside specs (e.g., submersion or waterline for non-submersible films), and color shift from aging/oxidation.
9) Color Match & Appearance
-
Exact color match is not guaranteed due to age, fade, and pigment variability. We blend for best visual match under normal daylight.
-
Polishing/oxidation removal may reveal underlying repairs or thin gelcoat. We may recommend refinishing if thickness is insufficient.
10) Vinyl Wrap Specifics (Pontoons)
-
Surfaces must be clean, de-oxidized, and dry; we may charge for necessary prep.
-
Wraps terminate above/below waterline per product spec; submersion voids warranty.
-
Care: hand-wash only; no abrasive pads/brushes/solvents; avoid fuel spills; rinse salt frequently. Detailed care sheets provided at delivery.
11) Risk, Liability & Insurance
-
We carry general liability insurance. Ask to view certificates.
-
Customer remains responsible for hull/machinery insurance and securing the vessel.
-
Limitation of Liability: To the maximum extent permitted by law, our total liability for any claim is limited to the lesser of (a) the fees paid for the specific job giving rise to the claim or (b) $[amount]. We are not liable for indirect, incidental, special, punitive, or consequential damages (loss of use, charter revenue, haul/launch fees, etc.).
12) Marinas, Yards & Third Parties
You authorize us to operate the vessel as needed for testing/movement within the marina/yard. You are responsible for any third-party yard fees, travel-ift, blocking, or environmental charges. We must comply with yard rules, which may affect schedule or methods.
13) Environmental, Safety & Hazardous Materials
We follow reasonable dust, masking, and containment practices and dispose of waste according to regulations. Work may be paused for unsafe conditions (storms, lightning, high winds, fumes). You agree not to direct methods that violate safety or manufacturer guidance.
14) Photos & Marketing
You grant permission for us to photograph/record the work (before/after) and to use images for portfolio/marketing, with identifying registration numbers blurred upon request. If you do not consent, notify us in writing before work begins.
15) Communication & Records
You consent to receive job updates, invoices, and reminders by SMS/email. Electronic approvals, messages, and photos form part of the job record.
16) Privacy
We collect only necessary contact, vessel, and service information to perform work and maintain records. We do not sell personal data. See our separate Privacy Policy for details.
17) Force Majeure
Neither party is liable for delays or failure to perform due to events beyond reasonable control (severe weather, supply chain disruption, labor strikes, illness, acts of God, government actions). Time for performance will be extended accordingly.
18) Disputes, Governing Law & Venue
These Terms are governed by the laws of the State of Maryland. Venue for any dispute shall be the courts of Worcester County, Maryland. The parties will first attempt good-faith resolution; if unresolved, claims may be filed in the appropriate court.
19) Severability & Updates
If any provision is unenforceable, the remainder remains in effect. We may update these Terms at any time by posting the revised version on our website; changes apply to work authorized after the new effective date.
20) Acceptance
By approving an estimate, paying a deposit, scheduling service, or allowing us to begin work, you acknowledge that you have read, understand, and agree to these Terms & Conditions.
